Important Legal Notice

ATTENTION: This legal notice applies to the entire contents of the Online Community and to any correspondence by e-mail between Blackstar Amplification Limited (“the Company”) and you. Please read these terms carefully before using the Online Community.

Using the Online Community indicates that you accept this legal notice in full regardless of whether or not you choose to register. If you do not accept these terms, do not use the Online Community.

This notice is issued by BLACKSTAR AMPLIFICATION LIMITED.

 

1. Definitions

The following words and expressions have the following meanings unless inconsistent with the context:

  • “Commercial Gain” includes, without limitation, using the Online Community as part of advertising which may result in revenue generation or personal gain, selling goods or services, or copying, reproducing, distributing, publishing, transferring, licensing, selling, commercially exploiting or duplicating any element of the Online Community whatsoever.
  • “Company” means Blackstar Amplification Limited, registered in England and Wales (Company No. 05187927) with its registered office at Beckett House, 14 Billing Road, Northampton, Northants NN1 5AW. Contact: support@blackstaramps.com.
  • “Architect Software” means the software licensed to you by the Company that enables access to the Online Community.
  • “Online Community” means the part of the Architect Software which enables you to upload and share patches, browse and download content from other users, interact through profile features, and access enhanced amp control features.
  • “you”, “your” means any individual or entity accessing the Online Community.

 

2. Introduction

2.1 You may access the Online Community by registering your details with us. You are responsible for keeping your login credentials confidential.

2.2 By accessing any part of the Online Community, you accept these terms in full.

2.3 These terms may be updated from time to time. You should review the current version regularly, as continued use constitutes acceptance.

2.4 The Online Community is intended for global use. Users accessing from outside the UK are responsible for compliance with their local laws.

 

3. License

3.1 You may print or download content for personal, non-commercial use, provided:

3.1.1 The content is not modified;

3.1.2 Graphics are not used separately from accompanying text;

3.1.3 Copyright and trademark notices are retained.

3.2 The Company or its licensors own all rights in Online Community content. Any other use is prohibited unless expressly authorized.

3.3 You may not store content from the Online Community on other websites or retrieval systems without permission.

3.4 All rights not expressly granted are reserved.

3.5 You must not use the Online Community for Commercial Gain, including redistribution of patches via third-party platforms.

 

4. Service Access

4.1 While the Company aims for 24/7 availability, it is not liable for any unavailability.

4.2 Access may be suspended without notice due to maintenance or unforeseen circumstances.

 

5. User Content and Conduct

5.1 By submitting content (e.g. patches), you grant the Company and its users a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, distribute, adapt, and display that content for commercial and non-commercial purposes. You retain copyright.

5.2 You must not upload material that is:

5.2.1 Offensive, illegal, or otherwise inappropriate;

5.2.2 Unlicensed or infringes third-party rights;

5.2.3 Malware or technically harmful.

5.3 You agree to indemnify the Company for losses caused by your content or conduct.

5.4 Misuse, including hacking, is prohibited.

5.5 You may not use automated tools (robots, scrapers) to access the Online Community without express permission.

5.6 The Company may cooperate with authorities regarding misuse or violations.

5.7 The Company may remove user content at its discretion.

 

6. Links to Third-Party Websites

6.1 The Company is not responsible for linked external websites. Use at your own risk.

 

7. Community Content and Smart Links

7.1 The Company makes no guarantees regarding accuracy or availability of community content.

7.2 Some patches or content may be sharable via smart links. These links are subject to tracking and may expire. Users are responsible for any consequences of shared content.

7.3 The Online Community and its content are provided “as is” without warranties.

 

8. Liability

8.1 The Company is not liable for losses from use of the Online Community, except as required by law.

8.2 Nothing excludes liability for:

8.2.1 Death or personal injury due to negligence; or

8.2.2 Fraud; or

8.2.3 Any other non-excludable statutory rights.

8.3 You are responsible for any costs arising from your use of content or downloads.

 

9. Termination

9.1 Breaches of these terms may result in suspension or termination of your access or license.

9.2 The Company reserves the right to take any legal or technical action necessary in response to a breach.

 

10. Governing Law

10.1 These terms are governed by English law.

10.2 Disputes shall be subject to the jurisdiction of the English courts.
